Recently, the China National Intellectual Property Administration (CNIPA) issued a Notice of Closure of Invalidation Proceedingfor the invalidation case with case number 4W114288 (hereinafter referred to as “this case”), informing the patentee Denka Co., Ltd. that the requester in this invalidation proceeding, a certain biotechnology company in Chongqing, had submitted on December 3, 2022, a request to withdraw its invalidation petition against Chinese Invention Patent No. ZL201410058250.0 owned by Denka Co., Ltd. (invention title: “Method and Kit for Quantitative Determination of Small Dense LDL Cholesterol”, hereinafter referred to as “the present patent”). The trial of this case has thus concluded.

Beijing Caihe Law Firm was entrusted by Denka Co., Ltd. to act as the patentee’s representative in the above invalidation proceeding.

Highlights of this case:

This case marks the fourth invalidation request filed in relation to the patent in question. As early as 2020, the same Chongqing-based biotechnology company and another bioengineering company (based in Beijing) separately filed invalidation requests with CNIPA against the present patent. After examination, CNIPA issued two invalidation examination decisions, both upholding the validity of the present patent. In February 2022, the Chongqing biotechnology company once again filed an invalidation request against the patent in question, but withdrew the request after the oral hearing concluded.
