Recently, the China National Intellectual Property Administration (CNIPA) issued Decision No. 588955 on Request for Invalidation Review, declaring the entirety of Chinese Invention Patent No. 202010189838.5 (invention title: Imaging Spectrometer Chip with Both Spectral and Imaging Functions and Preparation Method Thereof, hereinafter referred to as the “Patent-in-Suit”) invalid. The patentee is a technology company based in Jilin Province. The CNIPA upheld the invalidation request filed by Beijing WithLight Technology Co., Ltd. (hereinafter referred to as “WithLight”).

Previously, the patentee had instituted an action for patent infringement against WithLight before the Shanghai Intellectual Property Court based on the Patent-in-Suit. As the Patent-in-Suit has now been declared invalid, WithLight has, in accordance with relevant laws, requested the court to rule to dismiss the patentee’s infringement claim.
