On September 7, 2020, the Beijing Intellectual Property Court issued Civil Judgment (2017) Jing 73 Min Chu No. 1942 in the case where Guangzhou Zunwang Shangtong Information Technology Co., Ltd. (hereinafter “Zunwang Shangtong”) sued the Commercial Certification Center of the China Council for the Promotion of International Trade(hereinafter “Commercial Certification Center”) and Beijing Siyuanyujian Technology Co., Ltd.(hereinafter “Siyuanyujian”) for infringement of computer software copyright. The court found that the two defendants, Commercial Certification Center and Siyuanyujian, had committed joint infringementand should bear joint and several liability toward the plaintiff, Zunwang Shangtong.

Beijing Caihe Law Firm was retained by Zunwang Shangtong to act as the plaintiff’s representative in the above case.

Key highlights of the case:

1、The plaintiff was fully prepared with evidence, submitting a total of 29 pieces of evidence.

2、The defendant’s source code collected during evidence gathering contained the plaintiff’s corporate website and logo, which, to a certain extent, corroborated the defendant’s infringing acts.
