Recently, the China National Intellectual Property Administration (CNIPA) issued Invalidation Decision No. 5880655, declaring Chinese Utility Model Patent No. 202122937813.1 (title: “An Airflow Guiding and Smoothing Device for Pulmonary Function Testing”, hereinafter referred to as “the patent in suit”), owned by a certain technology company in Chongqing, wholly invalid, thereby supporting the invalidation request filed by the requester.Previously, the patent in suit had been the subject of two prior invalidation requests filed by different requesters, and on those occasions it was partially upheld as valid. The success of this latest invalidation request was attributable to the prior art evidence retrieved by Tangsong Yongxin Intellectual Property Agency Co., Ltd., which included two German patent documents, one Japanese patent document, and one European patent document.

Beijing Caihe Law Firm was retained by the invalidation requester to act as its agent in the above invalidation proceeding.
