Recently, the National Intellectual Property Administration made the Decision No. 584526 on the Request for Invalidation Review in response to the request for invalidation of the invention patent (entitled "Vertical Core Reel Conveyor System") with patent number 201010295608.3 filed by Shandong Hanrui Metallurgical Equipment Co., Ltd., the petitioner for invalidation, declaring the entire invention patent invalid. Previously, regarding this patent, the National Intellectual Property Administration had issued a prior Decision on the Request for Invalidation Review, which maintained the validity of the patent right on the basis of the claims announced upon authorization. Subsequently, Hanrui Company filed an administrative lawsuit against the prior decision with the Beijing Intellectual Property Court. On July 20, 2023, the Beijing Intellectual Property Court issued the Administrative Judgment No. (2022) Jing 73 Xing Chu 14391, holding that the relevant determinations in the appealed decision were incorrect and ruling to revoke the prior decision. Dissatisfied with the first-instance judgment, the patentee appealed to the Supreme People's Court. On May 15, 2024, the Supreme People's Court issued the Administrative Judgment No. (2023) Zui Gao Fa Zhi Xing Zhong 1081, holding that the first-instance judgment was correct and ruling to reject the appeal and uphold the original judgment. The National Intellectual Property Administration re-established a collegial panel to review the case and ultimately made the Decision No. 584526 on the Request for Invalidation Review, declaring the entire invention patent invalid.
